It's discrimination because it prevents two consenting adults from forming a union that is allowed to other pairs of consenting adults. Your second marriage would involve three adults (consenting or not), so it isn't the same thing.

Wel, actually, there are restrictions on the opposite-gender adults, too. Close relatives can't marry, for example. But I thought your point was, "Why is banning is banning same-sex marriage this discrimination?" It's discrimination because it's based soley on gender. No one is hurt by gay marriage, whereas marriage between close relatives could be harmful to the offspring of such a union.
